WEBSITE TERMS & CONDITIONS

These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the forthchildrenstheatre.org website (“Website” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and this Website operator (“Operator”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services. By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and the Operator, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

ACCOUNTS

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorised uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

 

TICKETS

 

Your ticket contract with us begins as soon as process the payment of your purchase and ends once the performance date you have purchased tickets for passes. Every ticket purchase is subject to checks including payment verification and your transaction may not go ahead if you fail one of these checks.

We will never sell our tickets via a third party, only on our website, by telephone or via a member of the Forth Children’s Theatre team. Tickets will be sent to you as an e-ticket, delivered to an email address of your choosing. No hard copies are available.

Tickets are sold subject to availability and a valid ticket must be presented upon arrival to our venues, either as a paper copy, printed by you, or on a device such as a mobile or iPad. Alternatively you may book tickets, subject to availability, at the venue on the night of a performance.

Babes in arms, those aged 18 months or under, may attend any performance free of charge. Please note: our performances are not designed for this age range and we ask you to exercise common sense in having your child attend. We also ask measures are taken to ensure your child is comfortable and you attempt to limit any disturbance they may make to the performance.

You are responsible for checking the details on the ticket to ensure no mistakes have been made. Should there be any errors, please contact us via email at contact@forthchildrenstheatre.org Altering any part of the ticket ahead of entry may invalidate your ticket.

We are not responsible for any ticket that may have been misplaced or destroyed however we do have access to any eticket booked. Should you have any issues finding your ticket, please notify us ahead of the performance with as much notice as possible.

The price of tickets are subject to change and will be set at the time we take payment from you. The price is inclusive of any taxes and booking fee, all of which will be shown to you at the time of purchase. Please note: the booking fee does not come to Forth Children’s Theatre but to our payment service Wix, in order to offer you a secure and streamlined booking process. We have done our due diligence in ensuring these fees are as cost effective as possible.

No ticket will be provided until full payment has cleared, whether booked online or in person via our Ticket Manager. We reserve all rights to cancel any booking at our discretion.

We reserve every right to make changes to our scheduled performances but will notify you of changes with as much notice as possible.

REFUNDS & EXCHANGES

We are unable to offer refunds once tickets have been purchased. If you cannot attend a performance an exchange is subject to availability. In order to qualify for the exchange please contact us by email at contact@forthchildrenstheatre.org at least 48 hours before your performance with your full name, event and date and when you would like to exchange them for.

CANCELLATIONS OR PERFORMANCE AMENDMENTS

In the unlikely event we cancel or alter any event, we will send round communications to all ticket holders and advise when the re-scheduled performance will take place. Should a refund be the only suitable option, we will contact you directly to arrange. Refunds will be made via our payment provider Wix to the person who made the booking only. Should your ticket have been purchased via our Ticket Manager, they will come to a suitable arrangement to return your ticket money to you. Your consumer statutory rights remain unaffected by these terms and conditions.

ADMISSION & REMOVAL CONDITIONS

We reserve the right to refuse admission to any of our performances at our discretion. We also reserve the right to ask any ticketholder to leave a performance on reasonable grounds. This may include an audience member who:

  • Is causing a disruption to our performers or other audience members

  • Is threatening, insulting or abusive

  • Threatens the enjoyment of our performers and audience members

  • Is under the influence of drugs and/or alcohol

  • No refund or exchange will be offered.

We will not tolerate any disruption to our performances, performers or events, all of which we take incredibly seriously.

PERSONAL LIABILITY

Any arrangement made, including travel or accommodation, related to your attendance of our event is made at your own risk. We are not responsible for any property lost or damaged whilst attending our performances but will endeavour to support you reclaim property where possible.

RESTRICTIONS AND PROHIBITIONS

  • Recording any part of our performances are prohibited. Any unauthorised recording equipment may be confiscated and anyone using their mobile device to record the performance, either video or photographic material, will be asked to leave. Official photographs of our performances will be available to view on our social channels.

  • All mobile devices must be switched off or placed on silent during performances.

  • Smoking is not permitted within our venues or rehearsal space unless at a designated smoking area.

  • We will endeavour to allow latecomers to enter the venue as quickly and quietly as possible. On the occasion where the performers need access, you will be held back until safe to take you to your seat.

 

ALCOHOL

  • Sales of alcohol are made subject to the Licensing (Scotland) Act 2005 for theatres in Scotland and any theatre specific conditions stipulated on the premises license.

  • We reserve the right to refuse any sale of alcohol at our discretion.

  • Proof of identity may be required to purchase alcohol. We operate a Challenge 25 in all of our event premises.

  • Only alcohol purchased in our event premises may be consumed.

 

HEALTH AND SAFETY

The health and safety of our performance and audience members is our main concern. Please comply with all information and advice provided by our dedicated volunteers who are on hand to help you enjoy yourselves. If you have a specific concern about any part of our performance, including any special effects, please contact us in advance. We will advise audience members of any strobe lighting, pyrotechnics or other effects that may cause distress ahead of a performance beginning.

ACCESSIBILITY

Although the Website and Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Website. Your linking to any other off-site resources is at your own risk.

CHANGES & AMENDMENTS

We reserve the right to modify this Agreement or its terms related to the Website and Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Agreement will be effective immediately upon the posting of the revised Agreement unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Agreement (or such other act specified at that time) will constitute your consent to those changes.

ACCEPTANCE OF THESE TERMS

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.
